No, Fair Use provisions do not apply

Until fall 2012, you were correct. Fair Use provisions, or Fair Dealing in Canada, are frequently cited in educational circles as the justification for use of copyright images. This only applied to print media and paper copies thereof.

Currently in Canada, there is now provision for digital media under section 30.04(1) of the Copyright Act. Hooray!

But be careful: you must not post protected, paywalled or digitally locked materials. And it must still be for educational use.
We suggest that you be especially cautious and not use materials from the following, commonly misused, sources:
  • Disney products - both images and animations - the company can be quite litigious
  • Getty Images - for most purposes, they expect payment
  • Netter anatomy - commonly misused in medical presentations
  • Cartoons - most cartoonists expect payment (most notably Larson's Far Side)
